3. Nature of the Platform

3.1 Contingency Infrastructure

The Platform is a proprietary Contingency Infrastructure environment — an isolated, pre-configured technical sandbox that hosts structured SAAS failure scenarios, incident response workflows, and codebase management tasks. It is not a live commercial product, educational institution, or employment service.

3.2 No Statutory Recognition

Spark is not a "University," "College," "Training Institute," or "Educational Institution" under the University Grants Commission Act, 1956, the All India Council for Technical Education Act, 1987, or any analogous state legislation. We issue no statutory degree, diploma, or qualification.

3.3 MSME Registration

Spark is registered under the Micro, Small and Medium Enterprises Development Act, 2006. Our Udyam Registration Number is UDYAM-AP-04-0139628. This registration is verifiable on the Government of India Udyam Portal.

4. Limited Operational Term — Fundamental Condition

4.1 Fixed Duration

This Platform is established for a predetermined, limited operational term ("Operational Term"), as prominently displayed on the Platform homepage. The Closure Date is a fundamental term of this Agreement.

4.2 No Perpetual Existence

By registering, you explicitly acknowledge and accept that:

  • The Platform does not and shall not exist in perpetuity.
  • The Company has made no representation that the Platform will continue beyond the declared Closure Date.
  • This limited duration is a material condition of this Agreement.

4.3 Extension at Discretion

The Company may, at its sole discretion, extend the Operational Term by publishing an extension notice. No User acquires any right to demand extension.

4.4 No Claim of Abrupt Closure

Since the Operational Term is declared prior to registration, any closure at or after the Closure Date shall not constitute "abrupt closure," "deficiency in service," or "unfair trade practice" under the Consumer Protection Act, 2019.

5. Services — Free Tier (Zero Cost)

The following services are provided at no monetary cost during the Operational Term:

  • Account registration.
  • Access to Contingency Project listings, technical specifications, and evaluation rubrics.
  • Read-access to GitHub repositories licensed under MIT License or equivalent open-source licenses.
  • Ability to clone, fork, and submit solutions via designated mechanisms.
  • Asynchronous, text-based technical guidance from the Technical Review Panel (limited to doubt clarification).
  • Evaluation of submissions against pre-published rubrics.

The Free Tier requires no monetary consideration. Your consideration is your compliance with these Terms.

6. Optional Paid Documentation Service

6.1 Voluntary Nature

Upon approval of your project, you may optionally purchase a Documentation Package for a one-time fee of INR 99 (Indian Rupees Ninety-Nine Only), inclusive of applicable GST.

Against payment, you shall receive:

  • Certificate of Contingency Completion (unique Certificate ID, date, technologies, digital signature).
  • Technical Performance Abstract (rubric-based evaluation).
  • Letter of Recommendation (narrative assessment on Company letterhead).

6.3 Execution & No Refund

Once the Documentation Package is transmitted to your registered email address, the transaction is fully executed. The contract is discharged by performance under Section 37 of the Indian Contract Act, 1872. No refund is payable for delivered documentation.

6.4 Exception — Non-Delivery

If the Documentation Package is not delivered within 72 hours of payment due to a confirmed Platform infrastructure fault, you may claim either re-delivery or a full refund. This is the sole and exclusive remedy.

6.5 GST Invoice

Every payment is evidenced by a tax invoice under the CGST Act, 2017 (SAC Code 9984), bearing Spark's GSTIN. This invoice is conclusive documentary proof of a legitimate service transaction.

7. User Access & Pre-Closure Rights

7.1 Unlimited Access During Term

During the Operational Term, you have unrestricted access to all Free Tier services. You may submit multiple projects and download any MIT-licensed repository, personal submission record, or project data.

7.2 No Guarantee Beyond Term

There is no guarantee of access beyond the Closure Date. You are advised to download all desired materials and complete submissions well before the Closure Date.

7.3 Repository Perpetuity

MIT-licensed repositories accessed through the Platform remain publicly available on GitHub in perpetuity under their respective licenses. Their availability is not dependent on Spark's Platform.
